Property Litigation

Property Litigation

Your Property, Our Expertise

We recognise that property litigation can be very stressful for the individual, as often it will involve disputes that go on for some time and are often with people you know, such as neighbours. We will always give you accurate up to date advice to make sure that you have realistic expectations of your case.

We will do everything we can to avoid costly action in the courts, such as organising, arranging and attending mediation, expert determination and arbitration and advising you on pre-action negotiations. There are occasions, of course, where court proceedings are unavoidable and, where at all possible, our solicitors will undertake the advocacy required, or where this is not possible we have good working relationships with barrister’s chambers in London and in Kent. We will work closely with our large property and conveyancing team where necessary. We will advise you thoroughly in relation to how to fund any claim that you might have and if you have the benefit of existing legal expenses insurance, we will liaise with insurers on your behalf to ensure you take advantage of that cover. Areas of work:

  • Boundary disputes
  • Adverse possession (claiming and defending claims)
  • Residential landlord and tenant issues (such as possession proceedings and repairs and dilapidations) acting for either landlord or tenant
  • Advice on Restrictive covenants such as enforcement or adherence
  • Rights of way and easements
  • Professional negligence claims in relation to conveyancing, surveying or other professional advice given in relation to your property

Please note that this is not an exhaustive list. If you have any questions or queries relating to any kind of property dispute, please contact our property litigation team.
